These terms govern your use of coastalluxuryai.com and the Coastal Luxury AI concierge (the "Service"). The Service is provided by Richard D. Ortiz, trading as Coastal Luxury AI, of Galveston, Texas, USA ("we", "us"). By using the Service you are contracting with us and you agree to these terms. If you do not agree, please do not use the Service. You confirm you are of legal age and, if you act for a business, that you are authorised to bind it.

What the Service is

Coastal Luxury AI is a concierge and planning service for Galveston Island, Texas. We use AI to interview you and draft an itinerary, and we coordinate requests with independent hospitality providers on your behalf.

What the Service is not

We are not the operator of the restaurants, charters, rentals, transport, or venues we suggest or contact. Each is an independent business with its own terms, prices, cancellation rules, and safety practices.
We do not guarantee availability, a reservation, a rate, or a booking. A request is confirmed only when the provider confirms it and we tell you so in writing.

We are not a travel agency of record, tour operator, or insurer, and we do not provide medical, legal, or weather-safety advice.

Requests and arrangements

When you ask us to help arrange a trip, we review the request and reply within one business day. We may decline or withdraw from a request. You are responsible for the accuracy of the details you give us (dates, party size, contact information) and for the payment terms, deposits, and cancellation policies of each provider. Any fee we charge for concierge coordination is disclosed to you in writing before you commit.

Founding Partner subscriptions (businesses)

Galveston businesses may subscribe to Coastal Luxury AI as a Founding Partner. The following applies to that subscription:

Price and billing. Founding Partner membership is US$49 per month, charged as a recurring monthly subscription that renews automatically until you cancel. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. We never receive or store your card details.
Cancellation and refunds. You may cancel at any time; cancellation stops future charges and you keep membership benefits until the end of the period you have paid for. We also offer a 30-day money-back guarantee — see our Refund Policy.
Plan changes. A plan change takes effect immediately and the difference is prorated against your current billing period.
Price changes. We will give notice before any change to your recurring price, and you may cancel before it takes effect.
What membership is. Membership means your business is included in our concierge recommendation network and may be suggested to guests where it fits what they asked for, receives a partner profile and local visibility on our site, receives qualified guest enquiries routed to you when appropriate, and has a direct contact channel to our team.
What membership is not. We do not guarantee bookings, leads, enquiries, traffic, or revenue of any amount. Membership does not include priority reservations, guaranteed placement, or category exclusivity unless we agree to that separately in writing. We make no promises beyond the services actually provided.
Eligibility and suspension. We review every application and may decline, suspend, or end a membership — for example where a business is not a fit, misrepresents itself, or where guest safety or reputation is at risk. If we end a membership without cause, we refund the unused portion of the current month.
Your content. You confirm you are authorised to represent the business you submit, and you grant us permission to use its name and public details to describe it to guests.

Nothing in this section changes how guest-facing purchases work: any payment a guest makes to an independent provider is governed by that provider's own terms, as described above.

Acceptable use

Do not use the Service unlawfully or to harass anyone.
Do not scrape, automate, resell, or overload the concierge chat, or attempt to circumvent rate limits and security controls.
Do not submit someone else's contact details as your own.
Do not submit sensitive information you do not want us to hold.
Do not commit fraud, send spam, infringe anyone's intellectual property, or misrepresent a business you do not own or represent.
Do not interfere with the security of the Service: no malware, probing, penetration attempts, reverse engineering, or unauthorised access.
Do not use the AI concierge to generate unlawful, hateful, deceptive, or impersonating content. You are responsible for what you submit and for how you use the output.

We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, repeated or serious policy violations, or where usage threatens the stability or cost of the Service. We keep a limited licence to host and process the content you submit solely in order to provide the Service, and we may remove or restrict content and refuse or filter AI output.

Service availability

We aim to keep the Service available but do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We grant you a limited, non-exclusive, non-transferable right to use the Service, and we retain ownership of the Service, its software, documentation, and branding.

AI output

Itineraries, timings, hours, tide and weather notes, and place details are generated with AI assistance and may be incomplete or out of date. Verify anything you rely on. Details in the AI & service disclaimer.

Intellectual property

The site, brand, and content are ours. Itineraries we produce for you are yours to use for your own travel. Third-party names mentioned on this site belong to their owners and are referenced for identification only — their mention does not imply any partnership, affiliation, or endorsement.

Liability

The Service is provided "as is". To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for the acts, omissions, cancellations, pricing, or safety of independent providers. Where liability cannot be excluded, it is limited to the concierge fees you paid us for the request at issue.
